Comment: The type of Government enshrined in the Preamble of the Indian Constitution. (2008, 20 Marks)
The Preamble never uses the words “parliamentary” or “federal”. It enshrines a type of polity, not a machinery of rule: India is to be a Sovereign Socialist Secular Democratic Republic, deriving authority from “We, the People” and existing to secure justice, liberty, equality and fraternity. The parliamentary and federal forms are choices made in the body of the Constitution, but they follow from, and are bounded by, this preambular type.
Five Adjectives, One Type of State

In Kesavananda Bharati (1973), S. M. Sikri CJ counted the republican and democratic form of government and the secular character of the Constitution among its basic features, which puts this type beyond the reach of amendment.
Democratic: Representative, Responsible, Substantive
- Representative: universal adult franchise was granted at once in 1950. Indira Nehru Gandhi v. Raj Narain (1975) held free and fair elections to be part of the basic structure, and Association for Democratic Reforms v. Union of India (2024) struck down electoral bonds to protect the voter’s right to know.
- Responsible, hence parliamentary: the Preamble’s democracy is given a parliamentary form through collective responsibility to the Lok Sabha (Art. 75(3)). B. R. Ambedkar defended the choice on 4 November 1948: the draft “has preferred more responsibility to more stability”, since a parliamentary executive is assessed daily through questions and motions, not only at periodic elections.
- Substantive: by listing social and economic justice before political justice, the Preamble makes democracy a way of life. It is not merely a method of choosing rulers, and that was Ambedkar’s case for social democracy as the base of political democracy.
A Republic with a Parliamentary Head
Republics usually pair with presidential systems; India combines an indirectly elected President (Art. 54) with a cabinet that governs. Ministerial advice binds him under Art. 74(1). The republican principle also runs deeper than the head of state: abolition of titles (Art. 18) and public office open to all make it a rejection of rule by birth.
Limited and Constitutional, Not Parliamentary-Sovereign
Because sovereignty lies with the people, Parliament is a creature of the Constitution, not sovereign in A. V. Dicey’s Westminster sense. Judicial review (Arts. 13, 32) and the basic structure make the type constitutional government. The federal question is left open: the Objectives Resolution’s “autonomous units” were dropped, and “unity and integrity” (1976) signals a holding-together union in Alfred Stepan’s sense. The Union is strong, but S. R. Bommai (1994) made federalism itself basic.
Welfare-Oriented and Secular
Dr. Balram Singh v. Union of India (2024) read “socialist” as a welfare-state commitment that leaves room for private enterprise, and “secular” as a basic feature. The government envisaged is therefore active, not a night-watchman: in Granville Austin’s terms, an agent of social revolution.
Assessment
Formally the type has held through eighteen general elections. Substantively it is strained: 46 per cent of Lok Sabha members elected in 2024 declared criminal cases, and Speakers’ handling of defection petitions still tests responsible government.
Conclusion
The Preamble enshrines a constitutional, representative, secular welfare republic grounded in popular sovereignty. Parliamentary and quasi-federal institutions are the body’s means of realising that type; the Preamble’s ends remain the test they must pass.
