But, the procedure is slightly different. The appointment of Chief Justice of High Court is dealt with in\u00a0<strong>Article 217<\/strong>\u00a0of the Constitution which states that he is\u00a0<strong>appointed by the President in consultation with the Chief justice of India as well as the Governor of the state<\/strong>\u00a0in question. The collegium headed by the Chief Justice of India gives recommendations for the appointment of High Court Judges.<\/li>\n\n\n\n<li>The\u00a0<strong>Section 45<\/strong>\u00a0in the\u00a0<strong>Government of Union Territories Act, 1963<\/strong>\u00a0states that the Chief Minister must be\u00a0<strong>appointed by the President<\/strong>. Rest of the Ministers are appointed by the President on the advice of the Chief Minister.<\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"why-7th-amendment-of-indian-constitution-was-formed\">7th Amendment of Indian Constitution:<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There are many famous people involved who supported this Act. Some of them are- Pt. Jawaharlal Nehru, Sardar Vallabhbhai Patel, Dr. B. R. Ambedkar, Potti Sreeramulu, Dr. Rajendra Prasad, Feroze Gandhi and many others.<\/li>\n\n\n\n<li>This Act was formed due to some of the<strong>\u00a0reasons stated below<\/strong>:\n<ul class=\"wp-block-list\">\n<li><strong>Demand for Linguistic States:<\/strong>\u00a0After India gained independence in 1947, there was an increase in linguistic communities\u2019 aspirations for the establishment of states based on their respective languages.<\/li>\n\n\n\n<li><strong>Potti Sreeramulu\u2019s Sacrifice:\u00a0<\/strong>A well-known social activist named Potti Sreeramulu made the ultimate sacrifice by going on a hunger strike to call for the establishment of a separate Telugu-speaking Andhra state.<\/li>\n\n\n\n<li><strong>Public Approach:\u00a0<\/strong>Support for linguistic states was greatly aided by grassroots movements and public opinion in India\u2019s many linguistic areas.<\/li>\n\n\n\n<li><strong>Administrative Effectiveness:<\/strong>\u00a0Reorganizing states according to their respective languages was thought to increase administrative effectiveness. States with populations who speak the same language were thought to have better communication, better government,\u00a0and a shared cultural identity.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Major Provisions of the 7th Amendment of Indian Constitution<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>Reorganization of States:\u00a0<\/strong>The primary purpose of the amendment was to reorganize states in India along linguistic lines.<\/li>\n\n\n\n<li><strong>Renaming of States:<\/strong>\u00a0The amendment led to the renaming of certain states to reflect the linguistic and cultural identities of the people residing there.<\/li>\n\n\n\n<li><strong>Abolition of Part B States:\u00a0<\/strong>The classification of states as\u00a0<strong>Part A, Part B, and Part C\u00a0<\/strong>was abolished.<\/li>\n\n\n\n<li><strong>Redefining Union Territories:<\/strong>\u00a0The amendment also redefined the status and administration of certain Union Territories to better reflect the changing political and administrative landscape of the country.<\/li>\n\n\n\n<li><strong>Extended the jurisdiction of high courts to union territories.<\/strong><\/li>\n\n\n\n<li>Provided for the\u00a0<strong>establishment of a common high court for two or more states.<\/strong><\/li>\n\n\n\n<li>Provided for the\u00a0<strong>appointment of additional and acting judges of the high court<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"appointment-of-hc-judges\"><strong>Appointment of HC Judges:<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 217 of the Constitution:<\/strong>\u00a0It states that the\u00a0<strong>Judge of a High Court<\/strong>\u00a0shall be\u00a0<strong>appointed by the President<\/strong>\u00a0in consultation with the\u00a0<strong>Chief Justice of India<\/strong>\u00a0(CJI), the\u00a0<strong>Governor of the State<\/strong>.\n<ul class=\"wp-block-list\">\n<li>In the case of appointment of a Judge other than the Chief Justice, the\u00a0<strong>Chief Justice of the High Court is consulted.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Consultation Process:<\/strong>\u00a0High Court judges are recommended by a\u00a0<strong>Collegium<\/strong>\u00a0comprising the\u00a0<strong>CJI and two senior-most judges.<\/strong>\n<ul class=\"wp-block-list\">\n<li>The proposal, however, is\u00a0<strong>initiated by<\/strong>\u00a0the\u00a0<strong>Chief Justice of the High Court<\/strong>\u00a0concerned in consultation with two senior-most colleagues.<\/li>\n\n\n\n<li>The recommendation is sent to the Chief Minister, who advises the Governor to send the proposal to the Union Law Minister.<\/li>\n\n\n\n<li>The\u00a0<strong>Chief Justice of the High Court<\/strong>\u00a0is appointed as per the policy of having Chief Justices from outside the respective States.\n<ul class=\"wp-block-list\">\n<li>The Collegium takes the call on the elevation.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Ad-hoc Judges:<\/strong>\u00a0The appointment of retired judges was provided for in the Constitution under<strong>\u00a0Article 224A.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Under the Article, the\u00a0<strong>Chief Justice of a High Court<\/strong>\u00a0for any State may at any time, with the\u00a0<strong>previous consent of the President,<\/strong>\u00a0request any person who has held the office of judge of that court or of any other High Court to sit and act as a judge of the High Court for that State.<\/li>\n\n\n\n<li>Recently, the Supreme Court pushed for the<strong>\u00a0appointment of retired judges<\/strong>\u00a0to battle the pendency of cases in High Courts.\n<ul class=\"wp-block-list\">\n<li>It orally outlined prospective guidelines for the appointment and functioning of an ad-hoc judge.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Answer: (c) No procedure has been laid down in the Constitution of India for the removal of a Governor from his\/her post.
