Which one of the following Schedules of the Constitution of India contains provisions regarding anti-defection?"},"content":{"rendered":"\n<ul class=\"mcq wp-block-list\">\n<li>Second Schedule<\/li>\n\n\n\n<li>Fifth Schedule<\/li>\n\n\n\n<li>Eighth Schedule<\/li>\n\n\n\n<li>Tenth Schedule<\/li>\n<\/ul>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Answer: (d) Tenth Schedule<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"anti-defection-law\">Anti Defection Law<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Defection refers to\u00a0<strong>switching political allegiance<\/strong>, particularly when a member of a political party leaves the party and joins another party or becomes independent.\u00a0<\/li>\n\n\n\n<li>The anti-defection law<strong>\u00a0punishes individual Members of\u00a0Parliament\u00a0(MPs)\/MLAs for leaving one party for another.<\/strong><\/li>\n\n\n\n<li>Parliament added it to the\u00a0<a href=\"https:\/\/lotusarise.com\/upsc-notes\/constitution-of-india\/\">Constitution<\/a>\u00a0as the\u00a0<strong><a href=\"https:\/\/lotusarise.com\/schedules-of-the-indian-constitution-upsc\/\">Tenth Schedule<\/a>\u00a0in 1985<\/strong>. Its purpose was to bring stability to governments by\u00a0<strong>discouraging legislators from changing parties.<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>The Tenth Schedule<\/strong>\u00a0\u2013 popularly known as the Anti-Defection Act \u2013 was included in the Constitution via the\u00a0<strong><a href=\"https:\/\/lotusarise.com\/important-amendments-in-indian-constitution-for-upsc\/\">52<sup>nd<\/sup>\u00a0Amendment Act, 1985<\/a>.<\/strong><\/li>\n\n\n\n<li>It sets the provisions for disqualification of elected members on the grounds of defection to another political party.<\/li>\n\n\n\n<li>It was a\u00a0<strong>response to the toppling of multiple state governments<\/strong>\u00a0by party-hopping MLAs\u00a0<strong>after the general elections of 1967.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>However, it\u00a0<strong>allows a group of MP\/MLAs to join (i.e., merge with) another political party<\/strong>\u00a0without inviting the penalty for defection. And it does not penalize political parties for encouraging or accepting defecting legislators.\n<ul class=\"wp-block-list\">\n<li>As per the\u00a0<strong>1985 Act,<\/strong>\u00a0a\u00a0<strong>\u2018defection\u2019 by one-third of the elected members<\/strong>\u00a0of a political party was considered a \u2018merger\u2019.<\/li>\n\n\n\n<li>But the\u00a0<strong>91<sup>st<\/sup>\u00a0Constitutional Amendment Act, 2003,<\/strong>\u00a0changed this and now at\u00a0<strong>least two-thirds of the members of a party must be in Favour of a \u201cmerger\u201d<\/strong>\u00a0for it to have validity in the eyes of the law.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The\u00a0<strong>members disqualified under the law can stand for elections<\/strong>\u00a0from any political party for a seat in the same House.<\/li>\n\n\n\n<li>The\u00a0<strong>decision on questions as to disqualification on ground of defection<\/strong>\u00a0are referred to the Chairman or the Speaker of such House, which is subject to<strong>\u00a0\u2018Judicial review\u2019.<\/strong>\n<ul class=\"wp-block-list\">\n<li>However, the\u00a0<strong>law does not provide a timeframe<\/strong>\u00a0within which the presiding officer has to decide a defection case.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h6 class=\"wp-block-heading\" id=\"grounds-of-disqualification\">Grounds of Disqualification<\/h6>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Disqualification:<\/strong>\n<ul class=\"wp-block-list\">\n<li>If an\u00a0<strong>elected member voluntarily gives up<\/strong>\u00a0his membership of a political party.<\/li>\n\n\n\n<li>If<strong>\u00a0he votes or abstains from voting in such House contrary<\/strong><strong>to any direction issued by his political party<\/strong>\u00a0or anyone authorized to do so, without obtaining prior permission.\n<ul class=\"wp-block-list\">\n<li>As a<strong>\u00a0pre-condition for his disqualification<\/strong>, his abstention from voting should not be condoned by his party or the<strong>\u00a0authorized person within 15 days of such incident.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>If any\u00a0<strong>independently elected member joins any political party.<\/strong><\/li>\n\n\n\n<li>If any<strong>\u00a0nominated member joins any political party<\/strong>\u00a0after the expiry of\u00a0<strong>six months<\/strong>.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Exceptions:<\/strong>\u00a0The above disqualification on the ground of defection does not apply in the following two cases:\n<ul class=\"wp-block-list\">\n<li><strong>Merger:<\/strong>\u00a0If a member goes out of his party due to a merger of the party with another party. A merger takes place when two-thirds of the members of the party have agreed to such a merger.\u00a0<\/li>\n\n\n\n<li><strong>Presiding Officer:\u00a0<\/strong>If a member, after being elected as the presiding officer of the House, voluntarily gives up the membership of his party or rejoins it after he ceases to hold that office. This exemption has been provided in view of the dignity and impartiality of this office.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Deciding Authority:\u00a0<\/strong>The\u00a0<strong>Speaker\u00a0of the House or the Chairman of the\u00a0Legislative Council<\/strong>, as the case may be, has the authority to decide on questions relating to defection, and his or her decision is final and cannot be challenged in any court.<\/li>\n\n\n\n<li><strong>Rule-Making Power:\u00a0<\/strong>The\u00a0<strong>presiding officer\u00a0<\/strong>of a House is empowered to make rules to give effect to the provisions of the Tenth Schedule.
