by a majority of not less than two-thirds of its members present and voting<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"notes\">Notes:<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As per\u00a0<strong>Article 249<\/strong>, the Parliament can make laws on items in the\u00a0<strong>State List if the Rajya Sabha passes a resolution by 2\/3 majority of its members present and voting, that it is necessary for the Parliament to make laws on any item enumerated in the State List, in the national interest.<\/strong><\/li>\n\n\n\n<li><strong>Legislative Functions\u00a0of Parliament:<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Parliament legislates on all matters mentioned in the\u00a0<strong>Union List and the Concurrent List.<\/strong><\/li>\n\n\n\n<li>In the case of the\u00a0<strong>Concurrent List,<\/strong>\u00a0where the state legislatures and the Parliament have<strong>\u00a0joint jurisdiction<\/strong>, the\u00a0<strong>union law will prevail over the states<\/strong>\u00a0unless the state law had received the earlier presidential assent.<\/li>\n\n\n\n<li>However, the\u00a0<strong>Parliament can any time, enact a law adding to, amending, varying, or repealing a law made by a state legislature.<\/strong><\/li>\n\n\n\n<li>The Parliament can also\u00a0<strong>pass laws on items in the State List under the following circumstances:<\/strong><\/li>\n\n\n\n<li>If Emergency is in operation, or any state is placed under\u00a0<strong>President\u2019s Rule (Article 356)<\/strong>, the Parliament can enact laws on items in the State List as well.<\/li>\n\n\n\n<li>As per<strong>\u00a0Article 253<\/strong>, it can pass laws on the\u00a0<strong>State List items<\/strong>\u00a0if it is required for the implementation of international agreements or treaties with foreign powers.<\/li>\n\n\n\n<li>According to\u00a0<strong>Article 252<\/strong>, if the legislatures of\u00a0<strong>two or more states pass a resolution to the effect that it is desirable to have a parliamentary law on any item listed in the State List, the Parliament can make laws for those states.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Executive Functions (Control over the Executive):<\/strong>\n<ul class=\"wp-block-list\">\n<li>In the parliamentary form of government, the<strong>\u00a0executive is responsible to the legislature.<\/strong><\/li>\n\n\n\n<li>Hence, the\u00a0<strong>Parliament exercises<\/strong>\u00a0control over the executive by several measures.\u00a0<\/li>\n\n\n\n<li>By a\u00a0<strong>vote of no-confidence<\/strong>, the Parliament can remove the Cabinet (executive) out of power.<\/li>\n\n\n\n<li>It can\u00a0<strong>reject a budget proposal<\/strong>\u00a0or any other bill brought by the Cabinet.<\/li>\n\n\n\n<li>A\u00a0<strong>motion of no-confidence<\/strong>\u00a0is passed to remove a government from office.<\/li>\n\n\n\n<li>The\u00a0<strong>MPs (Members of Parliament)<\/strong>\u00a0can ask questions to the ministers on their ommissions and commissions.<\/li>\n\n\n\n<li>Any\u00a0<strong>lapses on the part of the government can be exposed in the Parliament.<\/strong><\/li>\n\n\n\n<li><strong>Adjournment Motion:<\/strong><\/li>\n\n\n\n<li>Allowed only in the\u00a0<strong>Lok Sabha<\/strong>, the chief objective of the adjournment motion is to draw the\u00a0<strong>attention of the Parliament<\/strong>\u00a0to any recent issue of urgent public interest.<\/li>\n\n\n\n<li>It is considered
