It declares India to be a Sovereign Socialist Secular Democratic Republic committed to Justice, Equality and Liberty for the people.<\/li>\n\n\n\n<li>In the\u00a0Kesavanada Bharati Case (1973), the Supreme Court\u00a0said that the\u00a0<strong>Preamble is part of the Constitution<\/strong>.<\/li>\n\n\n\n<li>The Preamble sets out the\u00a0<strong>aims and aspirations of the people\u00a0<\/strong>and these have been embodied in various provisions of the constitution.<\/li>\n\n\n\n<li>It certainly\u00a0<strong>does not have a legal effect independently<\/strong>\u00a0since it\u00a0<strong>cannot be enforced in a court of law<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h6 class=\"wp-block-heading\" id=\"status-of-preamble\">Status of Preamble<\/h6>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The preamble being part of the Constitution is discussed several times in the Supreme Court. It can be understood by reading the following two cases.\n<ul class=\"wp-block-list\">\n<li><strong>Berubari Case:<\/strong>\u00a0It was used as a reference under\u00a0<strong>Article 143(1)<\/strong>\u00a0of the Constitution which was on the implementation of the Indo-Pakistan Agreement related to the Berubari Union and in exchanging the enclaves which were decided for consideration by the bench consisting of eight judges.\n<ul class=\"wp-block-list\">\n<li>Through the<strong>\u00a0Berubari case<\/strong>, the Court stated that \u2018Preamble is the key to open the mind of the makers\u2019 but it can not be considered as part of the Constitution. Therefore it is not enforceable in a court of law.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Kesavananda Bharati Case:<\/strong>\u00a0In this\u00a0<strong>case<\/strong>, for the first time, a bench of 13 judges was assembled to hear a writ petition.
