Such regulations may prohibit or\u00a0<strong>restrict the transfer of land by tribal to non tribal members<\/strong>\u00a0or among members of the scheduled tribes, regulate the allotment of land to members of the scheduled tribes.<\/li>\n\n\n\n<li>If a particular area is brought under the Fifth Schedule,\u00a0<strong>it means that all land in Scheduled Area is presumed to have been Adivasi land; hence, not only should no land now pass into the hands of non-Adivasis<\/strong>, but any land presently owned by non-tribal should, if being transferred, come back to the hands of Scheduled Tribes.<\/li>\n\n\n\n<li>According to the provisions of Paragraph 4, under\u00a0<a href=\"https:\/\/lotusarise.com\/inshorts\/article-244-of-indian-constitution-upsc\/\">Article 244<\/a>(1) of Fifth Schedule of the\u00a0<a href=\"https:\/\/lotusarise.com\/upsc-notes\/constitution-of-india\/\">Constitution of India<\/a>, the\u00a0<strong>Tribes Advisory Councils (TAC)\u00a0shall be established in each State having Scheduled Areas therein and, if the President so directs, also in any State having Scheduled Tribes but not Scheduled Areas.\u00a0<\/strong>\n<ul class=\"wp-block-list\">\n<li>Tribal advisory council is an advisory body, not a governing body.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Law applicable to Scheduled Areas:<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Governor is empowered to direct that any particular act of Parliament or of the State legislature does not apply to a Scheduled Area or any part or shall apply with specified modifications and exceptions.<\/li>\n\n\n\n<li>The<strong>\u00a0Governor is empowered to make regulations for the peace and good government<\/strong>\u00a0of a Scheduled Area after consulting the Tribes Advisory Council.
