The committee\u00a0<strong>made a comprehensive examination of the law and problems relating to contempt of cour<\/strong>t in the light of the position obtained in our own country and various foreign countries. Pursuant to the recommendations made by the H N Sanyal Committee, the Contempt of Courts Act, 1971 was passed.<\/li>\n\n\n\n<li>The Supreme Court and the High Courts of India have been empowered with the power to penalize for Contempt of Court under\u00a0<strong>Articles 129 and 215<\/strong>\u00a0of the Constitution of India.<strong>\u00a0<\/strong><\/li>\n\n\n\n<li>The\u00a0<strong>Constitution of India does not define<\/strong>\u00a0<strong>Civil\u00a0<\/strong>Contempt<strong>\u00a0and\/or Criminal\u00a0<\/strong>Contempt.<\/li>\n\n\n\n<li><strong>Article 142 (2)<\/strong>\u00a0of the Indian Constitution clearly states that \u201csubject to the provisions of\u00a0<strong>any law made on this behalf by Parliament<\/strong>\u201d the Supreme Court shall have all and every power to make any order on the punishment of any contempt of itself. Thus, the parliament is vested with powers to make laws on Contempt of Court.<\/li>\n<\/ul>\n\n\n\n<h6 class=\"wp-block-heading\" id=\"contempt-of-court\">Contempt of Court:<\/h6>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Contempt of court seeks to protect judicial institutions from\u00a0<strong>motivated attacks and unwarranted criticism,<\/strong>\u00a0and as a legal mechanism to punish those who lower its authority.\n<ul class=\"wp-block-list\">\n<li><em><strong><mark>Note:<\/mark><\/strong>\u00a0Fair and accurate reporting of judicial proceedings will not amount to contempt of court. Nor is any fair criticism on the merits of a judicial order after a case is heard and disposed of.<\/em><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Statutory Basis:<\/strong>\n<ul class=\"wp-block-list\">\n<li>When the Constitution was adopted, contempt of court was made one of the restrictions on freedom of speech and expression under<strong>\u00a0Article 19 (2) of the Constitution of India.<\/strong><\/li>\n\n\n\n<li>Separately,<strong>\u00a0Article 129 of the Constitution<\/strong>\u00a0conferred on the Supreme Court the power to punish<strong>\u00a0contempt of itself.<\/strong>\u00a0Article 215 conferred a corresponding power on the High Courts.<\/li>\n\n\n\n<li>The<strong>\u00a0Contempt of Courts Act, 1971<\/strong>, gives statutory backing to the idea.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Kinds of Contempt of Court:<\/strong>\n<ul class=\"wp-block-list\">\n<li><strong>Civil Contempt:<\/strong>\u00a0It is the<strong>\u00a0wilful disobedience<\/strong>\u00a0to any judgment, decree, direction, order, writ or other process of a court or wilful breach of an undertaking given to a court.<\/li>\n\n\n\n<li><strong>Criminal Contempt:<\/strong>\u00a0It is the publication of any matter or the doing of any other act which<strong>\u00a0scandalises or lowers the authority of any court,<\/strong>\u00a0or interferes with the due course of any judicial proceeding, or obstructs the administration of justice in any other manner.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Punishment:<\/strong>\n<ul class=\"wp-block-list\">\n<li>The Contempt of Court Act of 1971 punishes the guilty with imprisonment that may extend to\u00a0<strong>six months or fine of Rs 2,000 or both.<\/strong>\n<ul class=\"wp-block-list\">\n<li>It was amended in 2006 to include\u00a0<strong>\u201ctruth and good faith\u201d as a defence.<\/strong><\/li>\n\n\n\n<li>It was added that the court may impose punishments only if the act of the other person substantially interferes, or tends to interfere with the due course of justice.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Which of the statements given above is\/are correct?
