class=\"wp-block-list\">\n<li>As per the provisions of the Constitution,<strong>\u00a0\u2018prisons\u2019 and \u2018persons detained therein\u2019 fall under the State List.<\/strong><\/li>\n\n\n\n<li>This means that the responsibility of prison management and administration solely vests with the state government, which alone is competent to make appropriate legislative provisions in this regard.<\/li>\n\n\n\n<li>So, the ministry also clarified while announcing the 2023 Act that<strong>\u00a0it \u201cmay serve as a guiding document for the States\u201d<\/strong>\u00a0so that they may benefit from its adoption in their jurisdictions.<\/li>\n<\/ul>\n\n\n\n<h6 class=\"wp-block-heading\" id=\"prisons-act-of-1894\"><strong>Prisons Act, of 1894;<\/strong><\/h6>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It\u00a0<strong>defined a \u201cprison\u201d\u00a0<\/strong>as \u201cany jail or place used permanently or temporarily under the general or special orders of a State Government for the detention of prisoners\u201d, excluding police custody and subsidiary jails.<\/li>\n\n\n\n<li>It\u00a0<strong>demarcated prisoners into three different categories according to the nature of their crimes<\/strong>, such as \u201ccriminal prisoner\u201d, \u201cconvicted criminal prisoner\u201d and \u201ccivil prisoner\u201d.<\/li>\n\n\n\n<li>The 1894 Act dealt with provisions for accommodation, food, clothing, bedding segregation, and the discipline of prisoners, including solitary confinement.<\/li>\n\n\n\n<li>It also laid down provisions for the prisoners\u2019 employment, health, and visits.<\/li>\n\n\n\n<li><strong>Flaws in 1894 Act<\/strong>:\n<ul class=\"wp-block-list\">\n<li>The act had\u00a0<strong>no provisions for reformation or rehabilitation and permitted \u201cwhipping, provided that the number of stripes shall not exceed thirty,\u201d albeit for only male prisoners.<\/strong><\/li>\n\n\n\n<li>This Act\u00a0<strong>did not apply to \u201ccivil jails in the State of Bombay, outside the city of Bombay, and those jails administered under the provisions of Sections 9\u201316 of the Bombay Act, 1874<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h6 class=\"wp-block-heading\" id=\"the-prisoners-act-1900\"><strong>The Prisoners Act 1900<\/strong><\/h6>\n\n\n\n<ul
